Decision 2652/QĐ-BCT: what should polyester filament yarn importers check?
On 13/10/2026, Vietnam’s Ministry of Industry and Trade (MOIT) issued Decision 2652/QĐ-BCT on the result of the sunset review (case ER01.AD10). It extends by 5 years the anti-dumping duty on polyester filament yarn originating from India, Indonesia, Malaysia and China (Article 1). The decision takes effect on 16/10/2026 (Article 3) and was signed by a Deputy Minister on behalf of the Minister.
This is an extension of an existing measure, not a new one. However, the rate table and the customs check procedure are set out again in the Notice attached to the decision, and 6 earlier decisions, including Decision 2302/QĐ-BCT of 2021, cease to be effective (Article 4). Below are the points importers should check now.
1. Products and HS codes
- Products: polyester filament yarn, mainly POY (partially oriented yarn), DTY (drawn textured yarn) and FDY (fully drawn yarn) (Notice, Section 1.a, page 4).
- HS codes: 5402.33.10, 5402.33.90, 5402.46.10, 5402.46.90, 5402.47.10, 5402.47.90 (Article 1; Notice, Section 1.b).
- Origin: India, Indonesia, Malaysia, China (Notice, Section 1.b).
2. Period of application
The rates in Section 3 of the Notice apply from 16/10/2026 until the end of 15/10/2031, unless changed or extended by another MOIT decision based on a review (Notice, Section 4, page 9).
3. Anti-dumping duty rates by country of origin
The rate table is in Section 3 of the Notice (pages 5–8). It has Column 1 (producers and exporters), Column 2 (related trading companies) and Column 3 (duty rate).
| Origin | Companies named individually in the table in the attached Notice | All other producers and exporters |
|---|---|---|
| India | 54.90% | 54.90% |
| Indonesia | 21.94% | 21.94% |
| Malaysia | 21.45% | 21.45% |
| China | 3.36%–17.45% (varies by row) | 17.45% |
For China, the table has 20 rows of individually named companies, and the rate differs by row. A named company’s rate applies only when the shipment passes every document check in the next section.
4. Three-step customs check: which documents are needed?
Customs checks the proof of origin and the producer certificate to decide whether goods are subject to the anti-dumping duty (Notice, Section 5.a, page 9). Proof of origin means a certificate of origin (C/O), or an origin self-certification that complies with CPTPP, RCEP, EVFTA, UKVFTA, ATIGA or the Vietnam–Israel FTA.
Step 1 — Proof of origin (pages 9–10)
| Case | Result |
|---|---|
| No proof of origin submitted | 54.90% |
| Proof of origin from a country or territory other than the four | No anti-dumping duty |
| Proof of origin from one of the four countries | Go to Step 2 |
Step 2 — Producer certificate (page 10)
A producer certificate is a document issued by the producer itself, confirming that the product meets certain quality standards. Customs compares it with the certificate template supplied by the Column 1 company in Section 3; MOIT forwards these templates to customs (page 9).
The country rate (India 54.90%, Indonesia 21.94%, Malaysia 21.45%, China 17.45%) applies if:
- no producer certificate is submitted;
- the name on the certificate does not match the name in Column 1; or
- the certificate differs from the template supplied by the Column 1 company.
Step 3 — Exporter name (pages 10–11)
If the exporter name on the sales contract, commercial invoice matches the name in Column 1, or the name in the same row of Column 2, the rate in Column 3 of that row applies. If it does not match, the country rate in Step 2 applies.
UNI’s view: to get a named company’s rate, a shipment must pass all three steps: proof of origin (a C/O or a self-certification), a producer certificate that follows the Column 1 company’s template and shows the Column 1 name, and an exporter name on the sales contract, commercial invoice that matches Column 1 or the same-row Column 2. Align the names on the producer certificate, contract and invoice with your supplier before shipment.
5. Existing exemption decisions and monitoring
- Exemption decisions for the products in Article 1 issued by the Minister of Industry and Trade before this decision takes effect continue to apply until the end of the validity period of that exemption decision (Article 2, page 2). If you hold an exemption, check the expiry date in your own exemption decision.
- After the decision takes effect, MOIT will check, monitor and supervise its implementation using information from customs on imports subject to the duty and on goods that may circumvent it (Notice, Section 6, page 11; based on Article 18 of Decree 86/2025/ND-CP).
