On July 22, 2026, the Government issued Decree No. 292/2026/ND-CP detailing certain articles and measures for organizing and guiding the implementation of the Law on Foreign Trade Management.
Effective date: from September 05, 2026. Fully replaces Decree No. 69/2018/ND-CP.

1. Addition of new groups of goods prohibited from import
Compared to previous regulations, Decree 292/2026/ND-CP has officially codified and added two extremely important groups of goods to the list of prohibited imports:
- Electronic cigarettes and heated tobacco products: Classified into the new list of prohibited imports and assigned to the Ministry of Industry and Trade for specialized management responsibility. This is a completely new regulation compared to the previous Decree 69/2018/ND-CP.
- Goods involving forced labor elements: The group of goods and products that are mined, manufactured, or produced wholly or in part through acts of forced labor by enterprises, countries, or territories (in accordance with international treaties to which Vietnam is a member) is now officially prohibited from import and assigned to the Ministry of Home Affairs for management.
2. Reform of the delineation of management authority among ministries
a. Transfer of authority from the Ministry of Information and Communications to the Ministry of Science and Technology and the Ministry of Culture, Sports and Tourism:
- Under Decree 69/2018/ND-CP, items such as used information technology products, publications, postage stamps, and radio equipment not conforming to planning fell under the management authority of the Ministry of Information and Communications.
- Under the new Decree, management authority is transferred as follows:
- The Ministry of Science and Technology manages the following items: used digital technology products; postage stamps subject to prohibition on trading, exchange, display, or dissemination; radio equipment not conforming to technical regulations or planning; and radioactive waste.
- The Ministry of Culture, Sports and Tourism manages publications banned from dissemination and circulation in Vietnam.
b. Transfer of authority from the Ministry of Transport to the Ministry of Construction:
The new Decree transfers all management authority over right-hand-drive vehicles, vehicles with erased or altered chassis/engine numbers, along with used transportation equipment and vehicles, from the Ministry of Transport to the Ministry of Construction.
c. Transfer of authority from the Ministry of Natural Resources and Environment to the Ministry of Agriculture and Environment:
Decree 292/2026/ND-CP transfers management authority from the Ministry of Natural Resources and Environment to the Ministry of Agriculture and Environment, while also expanding the scope of management from scrap, waste, and C.F.C.-based refrigeration equipment to controlled substances and equipment/products containing or manufactured from controlled substances, in accordance with commitments under international treaties on the protection of the ozone layer.
In summary: Enterprises engaged in import-export activities should proactively review goods names, the nature of goods, HS codes, and specialized management policies before Decree 292/2026/ND-CP officially takes effect in order to limit risks arising during import procedures.
