1. Key Contents
The Ho Chi Minh City Department of Construction announces the temporary suspension of the acceptance of applications for state inspection of quality of imported construction materials (CMs) within the territory of the City.
2. Reason for change
This temporary suspension arises from fundamental changes in the legal framework governing product and goods quality, effective from the beginning of 2026:
- Change in management model: As of January 1, 2026, the Law on Product and Goods Quality (amended in 2025) comes into force. The new Law changes the classification of goods from “Group 1 & Group 2” to three levels of risk: Low, Medium, and High.
- Change in authority and application submission method: Pursuant to Article 34 of the new Law, the registration for quality inspection of imported goods classified as high risk must be carried out via the National Single Window Portal.
- Incompatibility of previous regulations: Previous regulations stipulated in Circular No. 10/2024/TT-BXD and Circular No. 04/2023/TT-BXD (which guided enterprises to submit applications to local Departments of Construction) are no longer consistent with the new Law.
3. Current outstanding issues
Although the new Law has taken effect, the competent authorities of Vietnam are still in the process of finalizing detailed guiding documents:
- The Government has not yet issued a Decree guiding the implementation of the amended 2025 Law on Product and Goods Quality
- The Ministry of Construction has not yet issued a list classifying specific risk levels for types of construction materials products and goods.
Therefore, at present, there is no legal basis for the Department of Construction to continue accepting applications under the former procedures.
4. Guidance for Enterprises
- Procedures: Enterprises should proactively monitor updates and carry out registration for quality inspection of high-risk goods on the National Single Window Portal immediately after the guiding Decree and the risk classification list issued by the Ministry of Construction are promulgated.
