1. Main Content
The Department of Industry and Trade of Dong Nai Province announces the temporary suspension of acceptance of administrative procedure applications related to the chemicals sector from January 1, 2026.
2. Reasons for suspension
- Legal changes: The Law on Chemicals No. 69/2025/QH15 takes effect from January 1, 2026, replacing the old Law on Chemicals (No. 06/2007/QH12).
- Lack of guiding documents: Although the new Law has taken effect, there are currently no Decrees or Circulars providing detailed guidance on the list of chemicals, forms, and procedural sequences under the new law.
Therefore, authorized agencies managing chemicals in Vietnam do not yet have a legal basis to process applications in the chemicals sector.
3. Transitional provisions
Enterprises may continue to use licenses and certificates issued under the old regulations to continue chemical operations:
- Production and business licenses for chemicals: May continue to be used until the expiration date stated on the license.
- Certificates of eligibility for production and business: May continue operations until December 31, 2027.
- Special note: For chemicals newly added to the “special control” or “conditional business” lists under the new law, enterprises must fully comply with additional regulations before December 31, 2026.
- Incident prevention plans/measures: Documents approved before January 1, 2026 remain valid and enforceable.
5. Responsibilities of enterprises
While awaiting new guidance, entities must strictly maintain conditions regarding chemical safety, fire and explosion prevention, and environmental protection in accordance with current regulations.
The Department of Industry and Trade will issue notifications immediately when guidance documents from the Government and the Ministry of Industry and Trade are promulgated.
