On April 24, 2026, the Customs Authority issued Official Letter No. 15662/CHQ-GSQL providing guidance to enterprises on the use of the ® symbol on labels of imported products.
Main contents:
1. Regarding the ® symbol
– The use of the ® symbol may be considered a violation if it causes misunderstanding that the trademark is protected in Vietnam while in fact:
- It is not or has not yet been protected
- An application has been filed but no certificate has been granted
- The protection title has expired
– It is not a violation if information on the trademark protection status in Vietnam is presented truthfully and accurately.

2. Regarding supplementary labels
Supplementary labels must:
- Be a Vietnamese translation of the original label
- Supplement missing mandatory contents
- Ensure accuracy and not misrepresent the original content

3. Handling of violations
Providing incorrect information on trademark protection status is subject to a fine ranging from VND 10,000,000 to VND 20,000,000.
