On September 21, 2026, the Food Safety Authority issued Official Letter No. 1913/ATTP-KN on state food-safety inspection for goods on the list issued together with Circular No. 27/2026/TT-BYT. The notable point concerns how the regulations apply to food containers and packaging materials that come into direct contact with food upon import.
The detailed guidance is as follows:
- Carry out self-declaration of products: Packaging and containers made of synthetic plastic and rubber that come into direct contact with food and fall within the medium-risk group under Circular 27/2026/TT-BYT require enterprises to carry out self-declaration procedures under Decree 15/2018/ND-CP.
- Quality inspection under Decree 37/2026/ND-CP does not apply: Goods for which self-declaration has been completed are not subject to import quality inspection under the general provisions of the Law on Product and Goods Quality; specialized food-safety regulations apply directly instead.
- State inspection of food safety on import is still required: If the item is listed under Circular 15/2024/TT-BYT and is not exempt from inspection, the enterprise must still submit a state food-safety inspection dossier when carrying out customs procedures.
