On July 10, 2025, the Ministry of Industry and Trade issued Official Letter No. 5133/BCT-HC to express opinions on the conclusions of the meeting held on June 17, 2025 of the Ministry of Public Security, related to the management policy for goods containing industrial precursors. The contents of the opinions of the Ministry of Industry and Trade are as follows
1. The scope of management of industrial precursors.
- According to current regulations, the Ministry of Industry and Trade is responsible for the management of “chemicals” – including elements, compounds, or mixtures extracted or created by humans from natural or artificial sources.
- In addition, the Ministry of Industry and Trade also manages “industrial precursors” – chemicals used as raw materials, solvents or accelerators in production, scientific research, analysis and testing; at the same time, they are essential chemicals in the process of drug preparation and production, specified in the list issued by the Government (in Clause 5, Article 3 Decree 113/2017/ND-CP)
- Based on the above regulations, the Ministry of Industry and Trade affirms that products or goods containing industrial precursors are not under the scope of management of this agency.
2. Proposals to create conditions for businesses
- Request the Customs Department to allow enterprises to import products/goods containing industrial precursors according to the provisions of Article 7 of the Law on Enterprises 2020: “Enterprises are free to do business in all industries and trades that are not prohibited by law”
- After the goods are cleared from customs, the Customs Department is requested to notify the import and export of this item to the Ministry of Public Security, the Ministry of Industry and Trade and local authorities for coordination in monitoring and preventing the risk of loss of industrial precursors for illegal purposes.

3. Update on the amended Law on Chemicals 2025
On June 14, 2025, the National Assembly approved the amended Law on Chemicals at the 9th Session of the 15th National Assembly, which includes the following contents:
- Management of hazardous chemicals in products and goods.
- Corporate obligations: to publish information on the content of hazardous chemicals in products/goods on the Chemical Database, and at the same time, provide information to buyers and competent authorities when necessary.
- Strengthen post-inspection instead of pre-inspection.
- The Ministry of Industry and Trade (Department of Chemicals) will coordinate in drafting specific documents guiding the implementation.
