On August 15, 2025, Hon Gai Port Customs issued Official Letter No. 1339/HQHG-KTGSKS1 on supervising the process of specialized import-export goods sampling within the customs operational area. This document aims to enhance transparency, objectivity, and compliance in specialized inspections of import and export goods.

Details are as follows: 

1. Regulations on supervision of specialized inspection 

From August 15, 2025, the Customs authority shall supervise the sampling of exported and imported goods subject to specialized inspection within the customs operation area. 

2. Implementation procedures 

  • The enterprise (Declarant) must notify in advance the time and place of sampling when sampling goods subject to specialized inspection so that Customs can supervise. 
  • Sampling must be conducted in the presence of the declarant’s representative (stated in the letter of introduction or power of attorney). 
  • Samples must be sealed, and a sampling record must be prepared and certified by the declarant and the specialized inspection authority/organization.

4. Cases of invalid sampling

In cases where goods are sampled for specialized inspection within the customs operation area without the supervision of Customs, the analysis results and conclusions shall be deemed invalid and shall not be considered sufficient grounds for customs clearance.

4. Regulations on administrative penalties 

  • A fine ranging from VND 500,000 to VND 1,000,000 shall be imposed for failure to comply with the prescribed deadlines (e.g., declaration, submission, presentation, or updating of customs dossier information).

  • A fine ranging from VND 5,000,000 to VND 10,000,000 shall be imposed for failure to provide information and coordinate with Customs in monitoring, inspecting, and supervising goods entering, exiting, or stored in ports, warehouses, yards, customs clearance locations, consolidation, inspection, and supervision sites.
